We have recently observed a very significant increase in UKVI sponsor licence revocations across the sector.
Our understanding is that UKVI now has enhanced access to HMRC payroll data, which is being used to remotely identify cases where sponsored workers may be receiving pay below the required salary thresholds.
Importantly:
-
UKVI can now conduct these checks without carrying out a compliance visit.
-
Discrepancies between payroll records and sponsorship salary declarations can trigger enforcement action.
-
We anticipate that this elevated level of revocation activity is likely to continue.
Key Risk Area: Salary Compliance
Providers should ensure:
-
Sponsored workers are paid at or above the minimum salary threshold at all times.
-
Any variations (e.g. reduced hours, unpaid leave, sickness absence, maternity leave) are fully compliant with sponsorship rules.
-
SMS reporting obligations are met within required timescales.
-
Payroll data aligns precisely with Certificate of Sponsorship (CoS) details.
Even unintentional administrative discrepancies may now be detected via data matching.
We will continue to provide updated guidance.
